Ending E-Cigarette Mail Delivery.

The federal government recently passed legislation requiring the U.S. Postal Service (USPS) to prohibit tobacco sellers from mailing e-cigarettes, components, and accessories directly to consumers through the U.S. mail, subject to a few exceptions. As explained in the recent webinar and new factsheet, the law amends the Preventing All Cigarette Trafficking (PACT) Act to include e-cigarette devices among other products, such as cigarettes and smokeless tobacco products, that can only be sold by delivery under stringent regulations.   

Until March 22, 2021, the USPS is soliciting public comments on an implementation proposal for this legislation. While the USPS’s draft rules are not yet finalized, the agency’s intent appears to align with the definition adopted by Congress. Thus, the USPS’s rules will likely prohibit the mailing of most e-cigarette products and accessories within and into the U.S. The Center will provide updates as more news on the rules become available.
