Summary: The Tobacco Control Act provides for
penalties for violations of sale and distribution, including youth access, and
advertising and promotion restrictions for retailers who have implemented a
training program that complies with standards developed by FDA for such
programs. The guidance discusses the elements that should be covered in a
training program, such as: (1) Federal laws restricting the sale and
distribution, including youth access to, and the advertising and promotion of,
cigarettes and smokeless tobacco products; (2) the health and economic effects
of tobacco use, especially when the tobacco use begins at a young age; (3)
written company policies against the sale of cigarettes and smokeless tobacco
to minors; (4) identification of the cigarettes and smokeless tobacco sold in
the retail establishment that are subject to the Federal laws prohibiting their
sale to persons under the age of 18; and (5) age verification methods.
Relevancy: The FDA seeks comments on the draft
guidance for the retailer training program

written comments be faxed to the Office of Information and Regulatory Affairs,
OMB, Attn: FDA Desk Officer, FAX: 202–395–7285, or emailed to oira_submission@omb.eop.gov.
All comments should be identified with the OMB control number 0910–NEW and
title ‘‘Guidance for Industry on Tobacco Retailer Training Programs.’’ Also
include the FDA docket number found in brackets in the heading of this
document.
