In a major victory for public health, a federal court issued an order last month expediting the FDA’s process for establishing graphic warning labels for cigarettes. In 2016, several public health groups brought a case seeking to compel the FDA to issue a rule establishing graphic warning labels for cigarettes, as required under the Family Smoking Prevention and Tobacco Control Act. This month the Court ruled that the FDA’s proposed timeline for action is inadequate and must be significantly shortened. The Court ordered the FDA to complete its research by April 15, 2019 and to promulgate a proposed rule by August 15, 2019. In anticipation of that announcement, public health professionals might want to start thinking about submitting comments to the FDA this summer.

The Court ordered the FDA to finalize the graphic warning rule by March 15, 2020.
