Rethinking Commercial Tobacco Regulation

The U.S. Supreme Court’s decision in Wages and White Lion v. FDA (2021) reaffirms the key role of the U.S. Food and Drug Administration in regulating commercial tobacco. However, recent staffing shortages and restructuring has led to cuts in tobacco product research and cessation programs, creating uncertainty about federal regulation. As a result, state and local governments have become increasingly important in protecting public health.
